This Privacy Policy (“Privacy Policy” or “Policy”), our Terms of Service and Disclaimer are Agreements (“the Agreements”) between you and Lumovest. You agree that by using this Website (www.lumovest.com) and/or its Services (described below), you are agreeing to enter into a legally binding contract with Lumovest, LLC (“Company”, “we”, or “us”). You will be bound by these Agreements. If you do not agree to the Agreements, do NOT create an account and do not access or otherwise use any of our Services.

This Privacy Policy applies to www.lumovest.com, Lumovest-related sites, apps, communications and other services that state that they are offered by Lumovest (“Services”). Registered users of our Services are “Members” and unregistered users are “Visitors”. This Privacy Policy applies to both Members and Visitors, collectively, “Users”.s

1.2 Future Changes
We may modify this Privacy Policy from time to time without prior notice to you. It’s your responsibility to check this page periodically for updates. Any notice to you and its channel of communications will be determined by Lumovest’s sole discretion. If you object to any changes, you should close your account and discontinue any use of the Services. Your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that you are consenting to the updated Privacy Policy.

Unless otherwise noted, all of these changes are effective once posted on our site or by direct communication to you.

II. Collection of Data

2.1 Account Information
Visitors can browse our site without providing personal information, but you must be a Member to access most features of our Services. To create an account you must provide data including your full name, email address, and a password.

Once you become a member, you may have the option of providing additional account information, including but not limited to your education, social media profiles, physical address, date of birth, gender, etc. Don’t provide any information you don’t want to share. It’s your choice whether to include sensitive information on your profile and Lumovest has the option to make such information public. Please do not add personal data to your account profile that you would not want to be publicly available.

2.2 Billing Information
If you register for our Paid Services, you will need to provide valid payment (e.g., credit card, PayPal) and billing information.

2.3 User Content
Lumovest may collect and retain any User Content, in whatever format, submitted, posted, contributed, published or distributed on any of our Services by you, including but not limited to all notes, email messages, private messages, questions, answers, comments, posts, Feedback, text, analysis, spreadsheets, pictures, audio, videos and file upload.

Comments or other information posted or contributed by you to any part of our Services designed to be visible to the public or to other Lumovest participants may be viewed and downloaded by others who use or access our Services. Please bear this in mind when you post such comments or other information.

2.4 Service Use (Automatically Collected)
We automatically collect certain types of usage information when you visit our Website or otherwise interact with our Services. When you visit the Website, we may send one or more cookies — a small text file containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and lets us help you log in faster and enhance your navigation through the site.

A cookie may also convey information to us about how you use our Service (e.g. the pages you view, the links you click and other actions you take on the Services), and allow us to track your usage of the Service over time. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Service. We may also collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Services. These tools collect information sent by your browser or mobile device, including the pages you visit, your use of third party applications, and other information that assists us in analyzing and improving the Service.

When you access our Services by or through a mobile device, we may receive or collect and store a unique identification numbers associated with your device (“Device ID”), mobile carrier, device type and manufacturer, phone number, and, depending on your mobile device settings, your geographical location data, including GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device.

III. How We Use Your Data

3.1 Accessing Services
We use your data to authorize access to our Services. The data we collect help remember information so that you will not have to re-enter it during your visit or the next time you visit the site. We will also use it to provide custom, personalized content and information.

We use the data we collect from you to monitor User-specific and aggregate metrics including, but not limited to, total number of visitors, traffic, usage, video interaction, quiz grades, learning progress, Lumovest Achievements and demographic patterns on our Website and our Services.

We use the data we collect, including public feedback, to conduct research and development for the further development of our Services in order to provide you and others with a better, more intuitive and personalized experience.

3.4 Marketing

These activities may include interest-based advertising, targeted advertising and online behavioral advertising in order to increase the likelihood that the content would be of interest to you.

IV. How We Share Your Data

4.1 Affiliates of Lumovest, LLC
We may share your data with other companies owned by or under common ownership as Lumovest, LLC, which includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns. These companies will use your personal information in the same way as we can under this Privacy Policy.

4.2 Third Parties
We may share your data with third party vendors, consultants, contractors and other service providers that perform services on our behalf, in order to carry out their work for us, which may include web hosting / development, payment processing, content or service fulfillment, video hosting, accounting, or providing analytics services. They
will have access to your information as reasonably necessary to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes.

Any information or content that you voluntarily submit to the Service, such as User Content, may become available to the public and/or to other Lumovest Users, as controlled by any applicable privacy settings. Additionally, you may have the option to share your activities on our Services with your friends through social media. Lumovest does not have control over your information shared with third party social networks and you should review the policies of those networks before consenting to share information.

4.3 Legal Disclosures
It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce our agreements with you, (3) investigate and defend ourselves against any third-party claims or allegations, (4) protect the security or integrity of our Services (such as by sharing with companies facing similar threats); or (5) exercise or protect the rights and safety of Lumovest, our Users, personnel, or others. We attempt to notify Users about legal demands for their personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.

4.4 Change of Control
We can also share your data as part of a divestiture, sale, merger or change in control, or in preparation for any of these events. Any other entity which acquires us or part of our business will have the right to continue to use your data, but only in the manner set out in this Privacy Policy unless you agree otherwise.

V. Your Choices

5.1 Submitting Personal Data
You can always choose not to disclose personal information to us, but keep in mind you must provide your real full name, a valid email address and a password in order to maintain an account and you must provide valid billing information in order to purchase our Paid Services. Certain features of our Services may require additional information in order for you to use. You should not submit any information you don’t want to share.

5.2 Editing Personal Data
For Account Information data that we have about you, you can edit your personal data through your account.

5.3 Deleting Your Account
You may request deletion of your account by contacting Lumovest Support. Please note that the User Content you submitted to our Services may remain in our systems after deletion of your account. We do not control data that other Members copied out of our Services.

VI. Storage & Security

6.1 Storage
The information we collect about you through our Services may be stored and processed in the United States or any other country in which Lumovest or its subsidiaries, affiliates or service providers maintain facilities. Lumovest may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world.

Countries where we process data may have laws which are different, and potentially not as protective, as the laws of your own country, and you consent to the transfer of information to the U.S. or any other country in which Lumovest or its parent, subsidiaries, affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

6.2 Security
Lumovest cares about the security of your information and uses commercially reasonable safeguards, such as HTTPs, to preserve the integrity and security of all information collected through the Services. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Lumovest is not responsible for the functionality or security measures of any third party.

VII. Children’s Privacy

7.1 Children’s Privacy
Our Services are not intended for or directed at children under the age of 18. We do not knowingly collect or maintain information from anyone under the age of 13. If you believe we have obtained information from a child under the age of 13, please email us at support (AT) lumovest (DOT) com. We will delete any such information promptly from our systems.

8.1 Links to Other Websites and Services
We are not responsible for the practices employed by websites linked to or from our Website nor the information or content contained therein. Often, links to other websites are provided solely as pointers to information on topics that may be useful to the users of our site. Please remember that when you use a link to go from our Website to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including sites which have a link on our site, is subject to that website’s own rules and policies.

Please check the individual privacy policies before you submit any information to those websites.

8.2 Social Media
Our Services include social media features, such as the Facebook button. These features may collect your IP address, which page you are visiting on our Website, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our Website. Your interactions with these features are governed by the privacy policy of the company providing it.
